DUCATI SCRAMBLER CUSTOM RUMBLE - 2017 Edition
Art. 1 - Definition and organisation of the art competition
"Ducati Scrambler Custom Rumble" is an art competition ("Competition") organised by Ducati Motor Holding S.p.A., - Sole shareholder company, subject to the direction and coordination of Audi AG - with registered office in Via Cavalieri Ducati, 3 - Bologna, Italy, Italian VAT code 05113870967 (hereinafter "Organiser" or "Ducati")
Art. 2 - Object and purpose of the Competition
As better explained in the section "Participation in the Competition", the purpose of the competition is to reward the best so-called "customisation" of the motorcycles starting from one of the Ducati Scrambler versions ("Motorcycle"). The version to start from is at the discretion of the Competition participant, who can freely choose from the models of the Ducati Scrambler range ("Participant"). The winners will be given the opportunity to participate at a dedicated event in 2018 during which the finalists will be presented, as described in the "Voting, Finalists, Winners and Prizes" section.
The competition provides for the opportunity to register for one of the following four categories:

Depending on the category registered for, the following persons can participate in the competition in any country they are located in ("Participants"), producing/presenting Motorcycles by the deadlines set by the Competition:

To participate in the Competition, it is necessary to:

The Motorcycle will remain the property of the Participant, who will bear the costs of the customisation.
By registering, Participants consent to the use of the Competition Motorcycles for display at events if so requested by Ducati.
Art. 6 - Voting, Finalists, Winners and Prizes
Photos of the Motorcycles customised by the Participants and uploaded to the page scramblerducati.com/custom-rumble no later than 30 January 2018 will be added to a dedicated web page by Ducati to allow the Users to vote (scramblerducati.com/custom-rumble).
Throughout the entire period of the competition, the "work in progress" photos will be promoted and posted on the Instagram profile "https://www.instagram.com/customrumble"
Voting will take place using an online voting procedure on the dedicated web page. Each user, of any nationality, can vote for any Motorcycle participating in the Competition regardless of where the Motorcycle is located. Voting will close on 30 March 2018 at 5:00 pm (CET).
By 15 April 2018 the four finalist Motorcycles will be named for each of the following categories in the exact ranking, as voted by the users ("Finalists"):
The winner among the Finalists in each category will be the winner of its class ("Winner").
The four winners (one for each of the above categories) will be notified via email and announced on the website www.scramblerducati.com and on Scrambler social channels by 30 March 2018. Once the winners have been contacted they have 48 hours to reply from the time of notification of the message, otherwise the prize will be awarded to the next Participant in the ranking.
The four winning Motorcycles of the Competition with their creators will be presented at the event dedicated to this Competition in 2018. The best of the four will be voted by a special jury appointed for the occasion.
Travel expenses and accommodation of the winning Participants will be borne by each participant, while the cost of transporting the motorcycle will be borne by Ducati as part of the prize for winning the Competition.
The winner will be awarded a prize consisting of a vacation trip, the remaining three will be awarded prizes that will be specified during the promotion of the competition
Art. 7 - Period and validity
Registration for the competition begins 1 February 2017 at 9:00 am (CET) and closes 30 January 2018 at 11:59 pm (CET). Registrations received after that time will not be considered.
The 7 photos of the completed Motorcycles must be received no later than 30 January 2018 at 11:59 pm (CET). Photos received after this deadline will not be taken into consideration and cannot be voted for the selection of the Competition winners.
Art. 8 - Motorcycles and intellectual property rights
By participating at the Contest, the Participant assumes all legal responsibilities related to the customisation of the Motorcycle and the Material sent to Ducati, including breach of copyright and/or third party industrial rights. By registering their Motorcycle to the Competition and submitting the Material, the Participant hereby assigns to Ducati all economic rights for the Material as well as providing consent to display the Motorcycle at future initiatives and/or events if requested by Ducati. It is understood that Ducati is under no obligation to use the Motorcycles even if they are Finalists in their events.
Art. 9 - Treatment of personal information
Pursuant to and by effect of art. 13 of Italian Legislative Decree no. 196/2003, the personal data and images that are acquired by Ducati for this Competition are collected and processed with the aid of electronic means and for the purposes and activities connected to the Competition, including the organisation of exhibitions and publication on www.scramblerducati.com, www.scramblerducati.tumblr.com, the Ducati Scrambler page on Facebook, the @scramblerducati profile on Instagram and/or the Scrambler Ducati profile on www.vimeo.com, www.youtube.com or to comply with legal obligations. Regarding the existence and processing of personal data, Participants registered for the Competition will have the option to exercise the rights outlined in art. 7 of the aforementioned decree.
The controller of the data is Ducati Motor Holding S.p.A. in the person of its legal representative pro tempore Mr Claudio Domenicali.
Art. 10 Applicable Law
The rights and obligations arising from the Competition shall be governed by the Italian law.
The personal data provided by the User will be processed by the data controller Ducati Motor Holding S.p.A – A Sole Shareholder Company - A Company subject to the Management and Coordination activities of AUDI AG, with its registered office at via Cavalieri Ducati n. 3, Bologna, Italy (hereafter “Ducati”), its data processor Mr. Claudio Domenicali, for this purpose domiciled at the registered office of Ducati and by the other subjects specially appointed by Ducati, using prevalently electronic and automated means, in compliance with the provisions of the Italian Legislative Decree no. 196 of 30 June 2003 - Personal Data Protection Code, for the following purposes:
(i) to allow the User registration and her/his authorized access to the reserved area of the Ducati website, to supply the respective services as provided in the relevant Registration General conditions of contract, to allow the performance of this contract between Ducati and the User and all the related activities and obligations, included the personalised information service, and for statistical investigations in anonymous format. Only for the above-mentioned purposes your personal data may be communicated by Ducati to companies of the Ducati group, to Ducati subsidiary companies, to companies having a contractual relationship with Ducati and/or to companies part of the Ducati sales and assistance network (such as branches, importers, dealers, distributors, garages), even established outside European Union, and in this case these subjects will process data only for the above-mentioned purposes; data will be brought to data processors and persons in charge of the processing knowledge designated by Ducati
(ii) to allow Ducati and its sales and assistance network to fulfil market searches and customer satisfaction surveys. Only to these purposes your personal data may be communicated by Ducati to companies of the Ducati group, to Ducati subsidiary companies, to companies having a contractual relationship with Ducati (such as market research and data processing companies) or to companies part of the Ducati sales and assistance network (such as branches, importers, dealers, distributors, garages), even established outside European Union, and in this case these subjects will process data only for the above-mentioned purposes; data will be brought to data processors and persons in charge of the processing knowledge designated by Ducati and by said subjects.
Regarding the aforementioned purposes, except as specially indicated above, data provided by the data subject will not be assigned to third subjects by Ducati and will not be disseminated.
Providing your data for the purposes of point (i) is voluntary, i.e. it’s not required by the law, but it’s necessary to complete the registration process, to conclude and to perform the related contract. In default of providing the data indicated as “compulsory” in the registration form the consequence will be that you won't be allowed to complete the registration process and to conclude the related contract.
Providing your data for the purposes of point (ii) is voluntary, i.e. it’s not required by the law: in default of providing the data for these purposes the only consequence will be the impossibility to be contacted by Ducati and its sales and assistance network to fulfil market searches and customer satisfaction surveys.
For updating purpose, data provided by the User during the registration process may be checked with other data in Ducati’s lawful possession as provided by the User in other circumstances.
